What is the name of your state? Washington
Thank You, For your time, I may need to amend my bk papers, I filed on Sept. 30, 2005. 1st ? after I sent in all paper work I received a letter from a collecting agency on a creditor that turned it over to them , I included the creditor in bk but not the ca, as did not know it had been turn over to them. Do I need to add them now?: Also #2? On our car we owe $6,100 . Blue book 8,200 the only paper we put this on was sch. B, D, and Statement of Intention . Did I need to also list this on C even tho all of it is not excempt? are we ok if we did not. As we need to keep the car badly never late and plan to reaffirm. One last ? if we get a letter from a ca that is 10 years old do we list this also. Sorry if too long. Thank You For you response. PS Please if some one could answer , I sent in with my ch 7 paper work our statement of intentions Do we have to send a copy to the car loan company witch is the bank, to reaffirm this or does the court do this and we wait to hear from them? Please some one answer we are lost. Thank You All

You should not have to submit the name of the Collection Agency to the courts all you need to do is call the collection agency and let them know that you filed bankruptcy on this creditor and give them the case number the creditor will be notified through the court. You did not need to put your car on schedule C you already listed it on the correct schedules. No you do not need to send a copy of your intentions to the car loan company the court does notify them. although you do need to call them as soon as you can and let them know that you plan on reaffirming with them. Then when you have your 341 meeting of creditors they should have a rep there to have you fill out the reaffirmation documents this will avoid them coming to reposes the vechile. If you do not contact them they will not have the opportunity to talk over with you your reaffirmation and credit terms prior to this meeting.
