What is the name of your state? vt...asking for my sister in law. She has high cc debt and medical. Which is why her cc is high in debt. She also works and pays cs from a previous marriage. My brother has a good paying job now, but keeps his bills seperate from hers. They do not own a home, they rent. She lost her job for a little while and lost her car in a repo and owes well over 8,000 on that. If she files chapter 7, how will this affect her husband? Or can she do it without him? Are the laws her income only or both? Can she file without including her hubby in bk? Her hubby wants to buy a house through fha under his name only, and put her on the deed. Bank told him his good credit can get him a loan, but not his wife. How will her filing hurt him? thanks Faith

One spise may fle without the other. His income will have to be disclosed but, all his expenses will be deducted as part of the means test for houshold income. Unless the debts are joint, he should have no issues.
Many bk lawyers give free initial consultations. Talk with a couple and get all of your options explained.
For sure, he should not place her on a deed until her finances get straightened out.

What if the spouse pays for all the household expenses and wife is trying to pay off medical expenses? He has his own checking account to prove only he pays for those expenses. When she files bankruptcy only on her bills, does his income still matter too? thanks again.

As I said before, HH income is considered but, his expenses are then deducted.
A bk attorney will explain the entire process.
