First this is a no asset case, I hope. If I use the federal exemptions can I double all? Will be fileing a joint case. Also pro se as no money for atty. All income is social security income. If my bank loan papers for my 2004 auto says I have to redeem if I file bankruptcy, Does that mean I won't be able to reaffirm, We need the car for doctor and other. I have never been late on paymemts blue book value 8000.00 still owe 6100.00. Also own our mobilehome, free and clear aprox. 17,000.00 equity in it. Do we have to file a declaration of homestead with the county first befor we file? Last question if the trustee asks for the last two years tax returns, and we don't have any as we dont have to file tax returns because of all income from social security and less then 15,000.00 a year. what do we tell the trustee? Thank You.. Sorry for so long but please need help.

NO. They can't enforce that and reaffirmation or redemption is 100% VOLUNTARY, they cannot FORCE you to do anything. In WA you CAN keep secured property without redeeming or reaffirming and they cannot MAKE you do either. If you're current on your payments, they have no grounds to repossess.

It may not be required, but its not a bad idea to do it anyway, CYA ;)

The Trustees are well aware that some people, like yourselves, are not required to file tax returns. As long as you have proof of your income from SS, then that's what you'll need to show if asked.
