we are filing for chapter 7 soon. my wifes name is on her mothers checking acount for emergency reasons only. she does not have access to the check book but it is incase mom gets ill or something. do we need to add this to the bancruptcy and can creditors get to that account to ask for repayment or use as a assets. it's not our money.

Thanks...but isn't a trustee with chapter 13...this is a chapter 7 and we don't want her mom to even get wind of this...she is alittle paranoid and thinks everyone is after her money...but to keep anyone from asking, is it too late to get her name off the account ?

Trustees are assigned in Chapter 7 as well, not just 13.

If you haven't already filed, I suppose its possible to get your wife's name taken off the account. However, if the trustee discovers it, questions could still come up. I don't think the trustee will dig for bank accounts you don't list... perhaps one of the Sr. Members here can shed a bit more light on that possibility and the consequences.
