I filed for Chapter 7 about 5 yrs ago (in Texas). Some of the accounts on my credit reports state that they were "charged off" rather than included in the bankruptcy. Should I have these records corrected to show them as "included in bankruptcy" (which will report for 5 more years) or would it be better to leave them reported as "charge-offs" (which will drop off after 1 or 2 more years)?

The Bankruptcy itself will remain on your credit report for 10 years. However, any delinquent accounts whether included in your bankruptcy or listed as "charged off" will come off in 7.

In the entries that are listed as "charged off", does it show you still owing a balance? If it does, then that will not help you in the event you try and obtain credit. It looks like you still owe the $$, when in reality you don't, because you filed for Bankruptcy.

If it were me, I would go ahead and send in a COPY of your Disharge paper, a COPY of your Notice of Commencement, and a letter to the creditor (keep a copy of that too!) and mail it Certified Return Receipt asking them to update your account with the 3 major credit reporting agencies to "zero balance" and "included in bankruptcy". I would, also, get a credit report from Experian. They have the actual date the entry is to come off your record listed on the right hand side of each entry. This is a very helpful tool because if you watch, you can catch the credit bureau if they forget to take an entry out that is negative.

Of course, I'm no attorney and if I'm incorrect, I hope that one will speak up.

Credit Bureau Problems

MICHIGAN - What if the credit bureau still does not remove accounts associated with a bankruptcy, even when they have the paperwork showing the date filed, and the date of discharge, both of which are now more than seven years ago?
