I have a vehicle that was charged-off in 2000 due to a car accident. The accident occured in TX. The insurance of the person that was in fault refused to pay and my insurance refused to pay since I wasn't at fault. I continued paying on the car but when the lienholder found out about the accident, they sent back my last 3 months of car payments and defaulted the car onto my credit. The car is sitting at my parents house and they need to do something about the vehicle pretty soon. Is there any way to get the title to a car that was charged off to either sell it or salvage it or basically do anything with it? Any help would be appreciated.

Why wouldn't the at fault insurance pay? Was this person uninsured at the time? Did you have uninsured motorist coverage?

If he was uninsured then you would need to file a small claims for the fair market value of the car.

The at fault person had insurance. They just refused to pay. And I had full everything. My insurance just said they would not pay because it wasn't my fault. So I dropped them and got another insurance carrier. I had one of those local insurance companies and that was a problem to begin with.
