Allen, TX.

I rent an apartment that is supposed to be a Gated Community, I am sure but have been unable to find, that the complex is charging a fee that is incorporated into the tentant's monthly rent.
however, the Gates have NOT been closed for over a year now, I was told when I originially signed the paperwork back in August of 2007 that the problem would be fixed soon.
Here it is a year later and time for lease renewal, and my rent is going to be increased. Am I not eligible for sometype of reimbursement or compensation for paying for a promised amenity that I have not been able to have access to? Is there anything I can do to get reimbursement or stop an increase in rent if the Owner(s) have not fulfilled there advertised promise of a Gated Community?

Have you suffered damages (burglary, theft, etc.) that you can attribute occurred due to the failure to provide secure gates?? If not, then you have no claim for 'compensation'.

**A: you can sue then to fix the gates but keep in mind that they have no obligation to renew your lease when the time comes.
