charging me even though insurance is paying

What is the name of your state? Ohio

A fire broke out in my apartment. The aparment complex is charging me for the damage. However, so is their insurance separatly. I believe although can't really prove yet that their insurance paid them for the damage, but they are after me hoping to make more money. I've asked the apartment complex several times to give me proof that I owe them the amount that they said, that the insurance is not paying that. However they just keep giving me the run-around. All they say is that the lease says that I am responsible. If I am already paying the insurance for the damage, why should I have to pay the apartment as well? Are the apartment complex required to give me proof of the amount if I suspect that they are over charging me?

While they can't both charge you for the same thing, they can each bill you for the amount they pay. If there is a deductable the owners have to pay (or possibly some damages the insurance company would not pay for whatever reason), you would be responsible to the owners for that.

Tell the LL you need an accoutning of the damages. If anybody takes you to court they will need to disclose it to the courts anyway so they might as well cough it up now.
