Cheated on e bay

What is the name of your state? Illinois
I made a purchace on e bay and used pay pal to pay ($515.00). The item was never sent. I filed a claim and it was settled in my favor. I got $200.00 (less $25.00 service charge) from e bay. Pay pal says there is no money in the sellers account so there is nothing they can do. Where can I go from here?

Sue the seller in small claims court. You'll have to sue the seller in their own state.

Thank you for the reply. Where should I go to figure out how to go through small claims court in Ca? Would I have to appear? $? Thankx

Yes you have to appear. In fact, it will take at a minimum 2 trips, one to file the lawsuit and again for the hearing. And your travel expenses are not recoverable, you will be responsible for your costs to appear. You can ask that the filing fees be included in the judgment though. And that opens a whole new can of worms, if you were to win, you would have to try to collect. The court just grants you the right to legally collect your judgment, they don't collect the money for you.

Boy racer, your line at the end sure fits here! Thank you for the information. Are there any options to get my money back. I read a few months ago wher a guy was arrested for a very simular situtation near my home town.
PS I'm into dragster "Super Comp" racing. What tye of racing do you do?

dallas, please don't mention prepaid legal in these forums, they are just a ripoff. All you get for your fee is a letter or two written by an attorney (actually, probably the attorney's paralegal). Anything that requires actual representation costs a whole lot more. With all the info available on the internet today, folks can right there own letters just as well as any attorney's office.

And to wrenchone, I drove oval track stock cars for many years. Never been much into drag racing even though I live next door to a drag strip.

Hmmm that is odd, I have seen numerous times when a senior member replied to a post WITHOUT looking at the date but that is ok. Soon as a NEWBIE brings up old news you jerks are on top of them. I do beleive this is not your forum so bringing up old news is not YOUR business.:rolleyes:

First, a month or two is just a nanosecond in the legal environment. I searched and wanted to know if he had any resolution to his problem. That is the purpose of seeking advice insn't it....to gain a resolution?

Second, I am trying to find out if prepaid legal (or any other similar service) has actually worked for people with legal problems, or if it's just another mlm gimmick. So far, I've seen one positive, a couple of neutrals, and a couple of negatives. That's not very conclusive...especially when the one strong negative was about billing and not the actual service provided.

I am not in the mood for infantile responses from you today.

I have every right to ask that question, and if dallas wanted to get an answer regarding prepaid legal services, I suggest he PM any response to a thread that is older than a few days. Most of the OP's do not return here when they have gotten their answer, such as this and that at least 2 other threads have been pulled up that are old.
