I lived in an apartment over the summer. My roomate and I signed a 4 month lease. We agreed that I would pay 600 and my roomate would pay 400, and put down those security deposits respectively.

At the end of the lease in July, I went to the landlord and inquired about getting my deposit back, only to find out that my roomate had bounced every single check he had given her. (Why she accepted checks from him beyond the first one is beyond me) So now I am out a 600 dollar deposit. AND my credit rating is in severe jeopardy as the landlord is threatening to call a collection agency if the 1485 (285 in fees) isnt covered within days. Ive managed to stall her until now.

On top of that, a 180 check he wrote me for utilities at the apt bounced (a $10 returned check fee).

Now whats interesting is that the second check he took down to the landlord, he specifically told me it was going to bounce but that it would keep the landlord off his back for a few weeks while he gathered the money. He then lied to me that he had paid it off, as well as with each check after that.

When I twice confronted him in August about paying his debt off to maybe have a chance at getting the deposits back, he lied to me twice and said he HAD paid it off and that our deposits were in the mail.

I called the police to tell them they had a criminal in their town habitually passing fraudulent NSF checks, but they only told me to take him to small claims court.

I have the tenant ledger with full proof of each of his $400 checks bouncing, plus my personal bounced check. What can I do to get my money back!?

How should I approach the case? I have the tenant ledger showing each of his bounced checks to the landlord and also the bounced check to me personally...
