Child Support

Can a mother successfully sue for Child Support BEFORE a blood test has established paternity? They have had a relationship for over 15 years, have 1 daughter, and recently lived together in a home that was purchased for all parties.

The father has recently obtained a false Order of Protection against Mom and she has been put out. And consequently, Dad cannot have contact with the child until visitation is in place.

Need to know the appropriate steps. She doesn't want the motion thrown out at trial if the judge will say a test is needed first.

When the mother of the child petitions the court for child support she will name the man as the "alleged father" of the child - he will be served with notice that a petition has been file and if he will have two choices -- he may 1)sign the affidavit of paternity acknowleging he is the father of the child or 2)he will deny it and the court will THEN order a DNA test to resolve the matter. Either way, if he is proven to be the father of the child support will be calculated and ordered.
