child abuse accusations

Unlike the previous post, I have asked the child abuse office to look into what I would call abuse. My son has been spanked/punished w/a belt. This just happened recently and the abuse people told me parenting is subjective, and that it is ok unless there were marks left. I found out 3 days after the fact, so there may have been marks, but no way to prove it. Also, at 9 years old, and a sister 11, they are being left alone unsupervised while she is in school at night. I surely would look after them, only I don't know about these things until something extracirricular comes up, I take them, I return them and mom is not home. When the children are asked "Where is mom"?, they reply, shes at school until 10:00PM, it is now 8:00PM. The abuse people seem to think that at 11 years old, she can stay by herself for a spell, but supervising a 9 year old, I think not. She is not mine biologically, but she does come on the weekends.
I have tried discussing things w/their mother, we talk, I don't think like her, she hangs up the phone in my ear or slams the door in my face right after I'm accused of being a bad father, or some profanity I won't repeat here. I've wasted my last breath on this woman, I may need it to breathe someday

parenting is subjective. what you may consider wrong, others may consider proper. unless state laws have been broken there is nothing you can do. is there any state laws against leaving a 11 year old alone in charge of a younger child? if not there is nothing you can do. as far as punishment goes, you have already been advised of that. unless it is excessive punishment (i.e. welps, bruses, black marks ex.) then there is also nothing you can do. my advise would be to watch and document any and everything you see that might be abuse or indangerment. when the apropriate time comes, you will have the proof you need. good luck.
