What is the name of your state (only U.S. law)? CT

My husband and I were not married at the time of our daughter's birth and our future together was uncertain. We were married a year after she was born and have been married since (almost 11 years). He is not listed on our daughter's birth certificate and she has my maiden last name. She's old enough now to ask why and has said she would like her name to be the same as ours. We want to amend the birth certificate to list him as her father and have been given conflicting information as to the process.

Getting his name on the birth certificate and getting her last name changed are two completely separate issues. Changing her birth certificate may not require a court order. However changing her last name absolutely will require a court order.

Get a consult with a local attorney.

herein lies the issue. i have consulted with an attorney and spoken to the probate court and spoke to the town clerk. i get different answers from each. i guess first place to start is how do i get him listed on the birth certificate?

Talk to your state vital records department. Explain that the father was not originally listed on the BC and ask them what they require to add the father now. If they say a court order, then you will know that you also have to take that issue to court. If they give you steps to follow instead of that, then do that.
