Hi, I have a 5-year old little girl who's biological father has just come out of prison. Out of her 5-years he has been in her life for not even three whole months. My fiance has been raising our daughter as if she were his own. Paying daycare fees, and tending to her every need. Her biological father is a drug addict and has been incarcerated for most of his life. I do not want my daughter around him at all. He came looking for her at our church yesterday. My fiance went and talked to him and told him not to come around us at all. What rights does he have? I really do not even want my daughter to know that he is out. Was paternity ever established legally? If it hasn't been established the father has none, however your fiance cannot adopt her nor does he have rights to her.

you can hire an attorney and *attempt* to have his parental rights terminated (do not attempt this without an attorney) your fiance can not adopted her because you are not married and you must be for him to adopt. if there is no court order regarding visitation in place bio dad does not have the right to visitation, but he can certainly file for it.
