my question is this i am the father of 2 teenage daughters and i lost a custody case and my x was given custody of them in 1996 in the state of Va. in 1998 she did not want the children and called me up and said come and get them i said not until you have papers from your attorney stating i have custody she did just that ,i have had them for the past 3 years now she dont want them and wont let them visit her in the summers when they have no school.the 2 girls and myself live in Pa. all this time that i have had them she had not paid a dime of support and i never asked for it..but this past dec i filed for child support and she went to her attorney and is trying to get me to pay her for child support for the past 3 years and the girls have been with me ..also i might add that she has been claiming the girls on irs at end of year and the girls have been w/me i had to show proof and irs agreed w/me and she is now paying back what she was trying to get wrongfully.. she is about money only is it possible for her to get me to pay her child support when the girls have been with me for the past 3 years and i have a noterized signed paper by her and her attorney giving me custody in june of 1998? please i need a peace of mind she is trying to get 38,000. for support when all this time the girls have been with me..never was a concern of hers til i filed for child support. thank you very much for any insight uyou can give me. my email address is [email protected]

let her file for the back support.

when you go to court be able to show documentation from the school that the girls are attending. that will show the girls were in PA with you and not VA. it will list their address as yours, not hers. also bring the documentation from the IRS that will help.

the mistake was in not requesting a cease order on the support to her since the children would be living with you. she can file, but with documentation you should win.

the custody papers, they were signed and notorized but never given to the judge for signature? you could possibly have a problem with that, not sure. check with a local attorney.

another idea.

since the girls have been living with you for the past three years, why not file for a change of jurisdiction? this would require all future modifications to take place in PA instead of VA.

PA is their resident state now.
