I now have physical not legal custody of my 3 teen age children and I am still required to pay child support even though my ex is mentaly ill and the kids want to live with me. How do I go about changing our modified joint custody if he is living in Texas and we live in Alaska? Do I get a attorney here or there? Do I really need a attorney of is there some papers I can file myself if my ex agrees to the changes? Thanks

If the children have been with you in AK for the last 6 months and there is no pending court action anywhere else, then you get an attorney and file in the nearest court to where you live.

You could hire a paralegal to help you with the papers and filing but they will not be able to give you any legal advice and will just help with the forms. They are a lot cheaper than an attorney.

Living with wanted parent

I was divorced three years ago in Idaho and moved to Colorado with my two boys a year ago. I filed the proper papers at that time. When summertime came the boys went to visit their father in Idaho and called me at the end of visitation and said they wanted to live with their dad. I think it was because they missed where they grew up and they were having "fun" there. It's been five months now and they are here visiting with me and my new husband for Thanksgiving. No legal papers were drawn. I thought this would be a trial period first. We want them to stay and I think they do too. I don't want to lose them and I think this is a better enviornment for them. Their father abused my oldest son and myself. That's why I got divorced. Reading the mail I'm replying to says something about after six months he can file for primary custody? Is this true and what do suggest?
