I am a mother in the midst of a custody battle with my ex. His attorney has requested I submit to a deposition. My attorney is not available now or I would ask him. Is this optional, or must I submit to this? What are the advantages of doing this?

Please give state you are in!!!
I don't know if they can force you ( I THINK a lawyer can, by subpoena ) but the advantage is it gives you a chance to see what kind of questions may be asked in court. Also what the attorney's "style" is ie. very aggressive.
A judge is not present and anything can be asked, a court reporter will be there with both lawyers. You can also depose him or any of his potential witnesses.

His attorney's request didn't come through YOUR attorney?

The request did come through my attorney. I received a letter last friday after his office was closed. It was very vague so it did not say if I had to submit to the deposition. I will be able to reach my attorney this week, but wanted to get an idea before I spoke with him. We have already been through the investigation process, and we are waiting to be scheduled for a final hearing.
