I need to know how to file for an emergency child custody hearing with the family court in the following case:
Parents never married, no open case with the family court. Birthfather currently has physical custody and is refusing visitation. We need to establish joint custody by Christmas to ensure that Angela gets to see her daughter before the holiday.

She needs to get an attorney... There is no other way she can progress this quickly without one. The best she can hope for is court ordered visitation before Christmas. Document the denied visitation as it will go against him.

Why does the father have custody ? and is it court ordered ?

There is no custody file surrently open regarding the child, and she is with her birthfather, who will not allow her visitation.

She has no income, and cannot afford a lawyer. I am supporting her and her other child right now, but i can't afford to hire her a lawyer. I am planning to represent her in court myself. I am not a lawyer, but I am educated, and I know how to do the research. I've done a divorce, but never custody for a non-married couple. I just don't know where to start.

What I need to know is, what to file in Michigan to get an emergency custody hearing. I can get the proper documents and file them, I just need to know which ones to use.
