My neice has shared custody of her 8 month old son with the father of the baby. she is interested in coming back to NH for her own welfare as well as the baby's. Can he hold her back, does she need his permission to return home and must they go to court in order for her to return legally? He has threatened her with kidnapping charges if she leaves. Thanks...look forward to hearing from you. They now reside in the state of Utah and we are not familair with their laws.

The father has rights, the same has the mother. She probably has one of three deals here: Sole phisical/legal w/ visitation - joint legal w/sole physical and visitation - joint legal/physical w/ visitation. If it is other than the first one, then the father can hold back the move, depending upon the welfare of the child. However, that would be for the courts to decide.

She will need to petition the courts for approval to move since the father is going to fight it. She can get the visitation modified at that time to allow the father longer periods of visits in lieu of the more frequent. She may also be held responsible for shared cost of transporting the child or the father back and forth for visits.
