child custody modification???

I live in Texas. My ex-husband and I have joint managing custody of our three sons; however, he has physical custody of them. The boys are 10,11,and 14. The boys have made it known to both of us that they want to move in with me and my husband. My ex does not want this though. His wife has been mistreating the children both mentally and physically. A case has been filed with CPS, but due to no bruises being found on the boys they are unable to do anything. The children have been with them for about 3 years. Before that the boys lived with me for a period of 2 1/2 years (while my ex was in prison for a DUI). But i was stupid and didn't take him to court while he was in prison and when he got out, he came and took the kids away from me. He had the children for about a year after our divorce before he went to prison. The childrens grades have been dropping and my oldest son has been in trouble with the law twice and is currently on probation. They also live in Texas about 240 miles away from me. And now the boys are telling me that their dad is planning on moving them out to Arizona this fall. He has no reason to. He has a good job here in Texas, and I can only think the only reason is to get the kids away from me. His wife does not like me and trys to stir trouble any chance she gets. She has even told the boys that if there dad dies or goes back to prison that she would get custody of them and that they would never see me again. I know that this is long and it is a rather sticky situation. But i would like to know at least what my options are. I dont have alot of money so I am trying to find the best route to do this. Thank You.
