I have a 4 month old son, who I allow to go spend one night a week with his dad. I am uncomfortable with this, because I never know if the dad will stay at home or at a girlfriends house. When I ask he gets all mad and we end up fighting. I don't ask for much. Occasionally I ask for money to help pay our son's medical bills and I ask for the dad not to take our son to his girlfriends house. Getting the money is like pulling teeth, I pay $ 200 a month in bills, and he has paid a total of $160. He has lied to me about where they spend the night and refuses to call me and let me know where they are. I am trying to be cooperative, but he isn't. If I take him to court what would his rights be to visitation and support? Am I better off staying out of the court system? I really don't want my son gone for more than one night at a time, if that long.

So you are allowing visitation even though there is no court order.. and you are allowing him to pay when he feels like it.. all the time he lies and does not listen to your requests..

You should petition the courts for a) custody b) standard visitation for him (weekends and holidays) and c) Child Support.
