I have a friend of mine that lived in Ohio. He was married and had 2 children. He came home one night and his wife and children were gone. She took the children and moved them across state lines into Indiana. Because they were married at the time and had joint custody and they were still living together and the divorce was not filed until after she moved to Indiana, is this kidnapping?

if they were married, and there was no order for seperation yet, there was no kidnapping, as each parent can go where they like with the children, while married. (joint custody only applies in divorced or unmarried situations)

It was up to your friend to file fo rdivorce in Ohio, to make his wife come back to the state with the kids.
