What is the name of your state?Idaho
My daughter just had a baby, (she is not married) and the father wanted
nothing to do with her, as soon as she got pregnant...now that the baby is
here, he wants nothing to do with my daughter, but wants custody of the
baby...What are his legal rights in the state of Idaho...and what are my daughters rights....The father's name is not on the birth certificate, and
the baby has my daughters last name....

At the moment he has no rights at all because he isn't legally the father. Before he can proceed with anything he will have to legally establish paternity through a court ordered DNA test...which will also put him on the hook for child support....so its possible that he won't do that...or at least not right away.

Unless he can prove your daughter legally unfit, the reality of the situation is that he will not get full or even primary custody of the baby. However its probable that he will get joint legal custody (joint decision making) and some form of parenting time. Most likely a phased in plan of some sort.
