In addition to previous post. I know my e-wife is leaving my child with her mother 95 percent of the time while she is running around with her new boyfriend. Is this considered neglect?
You didn't say what state you or your ex lived in but in my homestate of Maryland my wife and I have attempted several times to inquire about obtaining custody or at least guardianship of our granddaughter because our daughter always wants to party after work and doesn't want to take responsibility of her daughter. She will get either my wife and I or her boyfriends great grandparents or someone else in the family to alway watch her. We have inquired at the Department of Social Services on any number of occasions as well as sought legal advise and each time we are told that as long as the child is being taken care of there is nothing she or I could do. I don't know if this helps you any but I understand how frustrating it can get at times.

Not really as the child is being looked after by someone. It can be grounds for a change in custody but not really on its own, you need some meat to go with those potatoes you have.
