HI,I'm from Tx. Ok,My girlfriend's mom has our 1 year old at her house and she says that she has joint custody with my girlfriend but she never signed any papers giving het that.Can she still have joint custody? The grandmother filed for paternity and not custody and was supposevley given residency. How do I go about getting my son back? I called the clerks office that is how I know she didn't file for custody. I didn't make my court date for the paternity hearing because I was out of town on business and was never informed on a court date, does that matter? My girlfriend wants her son back and her mom says she got papers stating she has joint custody but her mom only let her read bits and pieces of it. Is it possible to get our son back without having to go to court? We can't afford a lawyer right now but we haven't lost custody. What should I do? At least I don't think we lost custody!!!!

Your girlfriend would have had to appear in court and have agreed to the joint custody as well as you. Go pick the child up and take her home. If grandma wants to pursue it do so through the courts. The mother (your girlfriend) has the right to pick up her child. The child is technically not yours yet because paternity has never been established.
I am also confused as to how the mother(grnadmother) could file for paternity when the mother is the one that would have to do so...
