I am not even sure that I'm divorced. We seperarted a year ago last Nov. In March we drew up legal papers to file for our divorce. I was living in another state and signed a wavier stating that I would not be present for the hearing. We agreed on joint legal custody of our children. A few months ago I asked about our final papers because I was told it would only take 90 days for the divorce to be final. I was told that the Judge would not grant our divorce without a primary custodian being named. He said he would be listed as the primary custodial parent and I agreed to this only because I was unemployed at the time and wanted my children fed and a roof over their heads. Now I have a job and am living in TX. They live in OK. My question is this, how do I find out about my divorce and get my girls living with me now. They are so unhappy living with their father. They are left alone alot and my daughters want to live with me. our 15 yr.old son has moved in with his aunt because of problems. My girls come to visit almost every weekend. I go pick them up as often as possible, every time I take them home they are miserable, because they want to stay. He and I have remained good friends and try to do what is best for our children. My girls are not taken care of emotionally and sometimes physically. I understand he cannot be mom, I am lost about what I should do. My daughters are 12 and 8. If the divorce has not been granted can they come live with me? Do I have to have his permission to keep them. Our papers aid they had the right to choose before each school year.

You need to contact the court that your ex would have used and search for any papers with regards to your divorce. Have you asked your ex ?

You need a copy of the papers before you can proceed..
