My husband has joint custody of his 5 yr. old. His ex wants to change custody if he is traveling when he has custody. What are his rights? AS a step parent, do I have the right to keep the child on the weeks we have custody if he is traveling for work? Are there any laws that support his right to keep custody when traveling?

What exactly is the arrangement.. who has physical custody? What is the visitation arrangement ?

We have joint legal and physical custody. We have the child for a full week every other week.We live in CT.

I judge would probably grant her request because the bio parents have absolute rights.. and a judge would see that the child is better off with the mother if the father is going to be away and now available for his week. Personally, I do not see it as an unreasonable request 'if' the father is going to be travelling.

Thanks legal beagle. She wants to change it if he is out of town more then 4 hours. I personally think that it is not a good thing for the child (too much instability). The child also has siblings here and not with her. That takes away the rights of the child to be with his siblings.What's your opinion?
