I ASKED THIS QUESTION THE OTHER DAY AND NEGLECTED TO PUT IN THE STATE. MY FRIEND LIVES IN PANAMA CITY, FL. HER EX-BOYFRIEND IS LISTED ON HER CHILDS BIRTH CERT. HE HAS BEEN ORDERED TO PAY CHILD SUPPORT ALTHOUGH HE DOESN'T. MY QUESTION IS, HE HAS THREATENED TO TAKE HER CHILD AND SHE DOES NOT HAVE THE MONEY FOR AN ATTORNEY. WHAT SHOULD SHE DO?

She needs to check her court order and see if it specifies his visitation or custody... if he has no visitation rights specified by court order she should not allow him visits until he petitions the court for them. Also, she can contact the CSEA in FL to help her collect her child support that he is supposed to pay.

Until he files for visitation rights, he has none, and if the court order does not specify who has custody, they both have equal rights under the law.
