I have joint custody of my son who lives with the mother.A
couple of days ago she went to prison for selling cocain.I
want my son to come live with me.The grandparents say they will charge me with kidnapping.Can they do that.I know I
have to get the papers modifies but i feel he needs me now.will I get into trouble for getting him before this is done.Please help.

Monday morning.. retain an attorney and ask him to file an Ex-Parte Motion for Emergency Temporary Custody.

Tuesday/Wednesday, have the police serve the court order to the GP and then take your son home with you.

That is.. if you have kept up regular visitation and been in your childs life..
