I am a mother of a beauitful baby girl.. I am not married to the father of the baby but we do live together.. I am not happy at all..We argue all the time and the last time he got violent and shoved me into the wall with my baby in my arms. I would like to know If I can take my baby across state lines so I know that she will not be in danger.. And now he has started drinking again.. Please help before it is to late..

I live in the state of Idaho and yes he is on the birth certitate.. And unforuantly she has his last name

Go to your local police station and tell them you want to press charges. Don't forget to tell them about the baby. Ask them to recommend to you a local domestic abuse shelter and go there.

Do not try to work things out with him. (He's not going to change, you said *last time* meaning this is not the first time.)

Once at the shelter ask if they have any legal information for you about TRO.

Once that is filed, move to said new state. Establish residency. File for Sole Custody with supervised visitation and for Child Support.

Please...from one abused woman to another -- GO NOW!!! He will NOT change ( they always promise to but never do)...and you owe it to yourself and most of all to your child to see to it that the two of you are safe. You MUST press charges against this man for domestic violence - when you go to court for sole custody of the child it will help immensley to have pressed charges instead of just leaving and it gets him put away (even if only for a day) so you have time to get your stuff and get gone. In your official police statement make sure it includes the fact that you were holding his child when he struck you - family courts don't look kindly upon this kind of man - it will assist you in obtaining sole custody and SUPERVISED visitation. I am originally from Idaho and know for a fact that it is full of shelters for women and children in just your sort of situation -- just a matter of finding them .... start with the police and if you can't do that then go to a church (any church regardless of if you are a memeber will help you)....do whatever you have to do to get out, PLEASE!
There are also special divisions of legal aid that are there to help women in your situation out - they will assist you with filing of your petition for custody and provide you with information/assistance to see you can make a good start for you and your child.
There is no excuse to stay -- I should know.....I used them all and it nearly cost me my life....go now!
