My son and his wife have won custody of his two children ages 4 and 5. The children's biological mother is a convicted felon and has just been sentenced to a year in prison. In the state of Oklahoma can parental rights be taken away from a non-custodial parent that is a convicted felon serving a sentence?

I believe that would have alot to do with what type of crime was committed. If it was any type of Domestic abuse then the chances are a little higher.

Regardless she is only going to be there for 1 year, which actually breaks down to about 4 months if she doesnt receive any type of disciplinary actions.

Also, if your son and his wife were to petition for custody she will have access to free legal assistance while she is incarcerated so that her rights were not violated. *Just something for you to think aout*
