What is the name of your state? oh
My grandsons "sperm donor" after 6 years is trying to get custody. He was arrested 1 week before Alex was born on an intimidation charge, he pulled my daughter down stairs trying to force her to give up her bank card for drug money.My daughter did not show up for court so the charge was dropped.He had court ordered paternity test as well as court ordered support. My daughter tried to let him visit but he started trouble as usual. He told Alex that he doesn't love him and he has to find a new dad. That was less than a year ago, now this. He has never even called him or mailed the little guy a birthday card is his 6 years. Can anyone tell me what his chances of custody or even unsupervised visitation rights could be?? Please help as this has the whole family quite upset. Thank you.

In Ohio, once he is established as the father, he will get a graduated visitation plan to establish a relationship which could start with supervised but eventually will be unsupervised leading into the full visitation allowed according to the county you reside in. Your daughter made a major mistake in now showing up for court so there is NO proof that that happened. And anyway, the alleged crime was not against the child but rather an adult. While it is still not a nice thing it will not hold much weight. Nor will anything that Alex's father said -- unless you witnessed it and can testify to it. That still would have credibility issues as you refuse to accept the fact that this man is your grandson's father. Prepare yourself because he will get some form of custody though not full custody. He will get parenting time and companionship with the child and it will most eventually, if not immediately, be unsupervised.

But before any of this you have to answer a few questions: was paternity established? Is there a child support order? If paternity has not been established then he is not the child's legal father. If he is paying child support through a court order then paternity has been established.

The reason you have not seen it is because it does not pertain to you. Period.

You are overinvolved, granny. It's not your fight, legally. And referring to the father of your *beloved* grandchild as a "sperm donor" is a stunning mistake. I don't care how big of a pig he is, your angel daughter had a child with him. That child is half-Dad. Figure it out from there.

Why didn't she show up for court? Why hasn't she reported any of the "trouble" he has started during visitation?
