I live in Georgia. I was married for 8 1/2 years to a man that was mentally and verbally abusive. Just before I left the abuse turned physical, that is when I made the decision to take the children and go to a friends house. But because of my fear of his temper I suffered and anxiety attack and out of fear that he was coming after me, I took the children back to him. My only thought at the time was that if he had the children he would leave me alone. The next day he got a restraining order to keep me from takin the children again. One week later he talked me into signing a settlement agreement that gave him custody of the children. I have been in weekly therapy since then trying to deal with the years of abuse and the loss of my children. I am now trying to dispute that agreement and get custody of my children, the settlement has not yet become an order of the court, however, a judge has already ruled that it is a binding agreement in a temporary hearing.
What is my best option for getting this settlement agreement set aside? What are my chances of proving that I signed the agreement under duress?
