MY DIVORCE WAS FINALIZED IN FLORIDA I MOVED TO TN 2 MONTHS AGO. MY 2 BOYS AGES 12 AND 14 ARE AT SUMMER VISITATION WITH THEIR FATHER. HE CALLED ME LAST SAT NIGHT STATING THE BOYS NOW WANTED TO LIVE WITH HIM WOULD I LET THEM. OF COURSE I SAID NO THAT THEY WERE NOT ABLE TO MAKE THAT DECISION. THERE IS A HX OF ABUSE BOTH MENTAL AND PHYSICAL AND HE GOT FIRED FROM A SHERRIFF DEPT FOR BEING TWO PHYSICAL WITH PEOPLE HE STOPPED. HIS PARTING WORDS WERE TO NOT PLAN TO HAVE THEM ON THE PLANE JULY 12TH TO RETURN TO HOME. I WOULD LIKE TO KNOW WHAT MY RIGHTS ARE IF HE DOES NOT RETURN THEM AND HOW TO DEAL WITH THE CHILD CUSTODY ISSUE WHEN THEY ARE WITH ME THEY SOMETIMES DON'T WANT TO TALK WITH HIM ON THE PHONE OR GO VISIT HIM. I DON'T WANT THEM TO USE US AS PAWNS. I DON'T FEEL IT IS IN THEIR BEST INTEREST TO LIVE WITH HIM. PLEASE ADVISE. THANKS

you may not like this answer, but right now there isn't a lot that you can do. he hasn't done anything wrong.

when you go to pick the boys up and they are not there and he refuses to return them - THEN you can do something.

if the boys want the change in custody, they are old enough that a judge would listen to their opinion on where they wanted to live. he would also listen to their reasons why and it would have to be more than just mom makes us go to be at a certain time and we can't do anything. judge should be able to see through that line.
