I live in California. I have two grandchildren that my daughter leaves with my husband and I. She is unseen or heard of for weeks on end. She is into drugs and alcohol. Childrens protective services has been involved, but will not remove the children from her as they "are with us when she uses". Their father is also into the drug scene, does not pay support, and rarely sees the children. Their mother has a job and is being relocated about 600 miles from us. She has asked us to keep the kids until the end of the school year. She does not provide us with clothing, food, or $$ to help support these children.

We do not have any legal documents giving us permission to make decisions where these children are concerned. She does not respond to pages, does not have a permanent residence, and the children have been subjected to abuse while in her care. . The children are 10 and 5. We had legal custody of the 10 year old for four years. His mother "cleaned up" and the courts gave the 10 yr old back to her. Now the children are in a constant state of turmoil as they do not know from one day to the next whether or not their Mother will show up and disrupt their schedule. We feel that something legal and permanent needs to be set in place so that we can have the freedom to carry on normal lives in her absence.

As grandparents do we have the right to file abdonment charges or obtain temporary legal custody without spending thousands of dollars that we do not have?
