Child doesn't want to visit with father

Live in NC. Father lives in NY. Divorce was granted in NY with permission to relocate 7 years ago. I have always been able to coax my child into going for visits up until the last year or so. Child is now 9 and doesn't want to go for visits. Child tells Father that she doesn't want to visit and can he come to visit her. Father doesn't care what child wants and says when child is old enough to decide and doesn't want to come then she doesn't have to. Isn't she old enough now to decide? And where should I file a petition? In NY or NC? Child is very upset by these visits because of emotional abuse at the hands of Dad & Step Mom. What can I do for my child?
