child emancipation

what is the legal procedure for emancipating a child from child support. My 19 year old son is still living at home and is working to help pay for his car insurance and save some money to go to school. My ex wants to emancipate from child support now, because he isn't going to school. My ex has been paying child support since our divorce in 1998, but hasn't helped paid for any other major expenses such as medical, dental, and insurance. My son is trying to help me with the car insurance payments because they are extremely high and since he lives with me, he is automatically placed on my policy. What are my options? Do I have any? Can my ex just stop child support or does he have to file paperwork through the court system to end it. I live in NJ.

He needs to file paperwork.. but he has a good chance since the child is 19 and not at school.. and worse, he is working. You should counter his petition with what he is in contempt for, ie all the other expenses he has not paid for.

Thank-you for your quick response. That answered my question about whether he could stop the child support payments on his own. I don't want to do anything illegal. When he does file the paperwork, we will both have to go to court? Or only go to court, if there are issues that need to be addressed. What happens if my 19 year old starts school in the summer or the fall. Will child support be re-instated automatically or will we have to go to court again? Thanks
