What is the name of your state?Texas
I was arrested for aggravated assault with a deadly weapon (my pick-up) by a 12 year old child. Can I sue for defamation of character or slander? What are the steps to this procedure?

Child falsely claims...

In a small town in Texas, my son, age 12 and a classmate, age 12, have been at odds in a "no tolerant" school system. While me and my son sat at the Sonic, the classmate rode his bicycle past and presented me with a well-known hand gesture (requiring only one finger) and I took off and went down the street he had been riding on and finally he came to a stop (approximately 30 FEET from my pickup) and I yelled, "This insanity has got to stop...both of you say your sorry." They both did and I told the other little boy to call me mam or I would go tell his mother right now. He said ok mam and I left to go back to the Sonic. Over a month and a half later, the police came to my house on a Friday evening after 5:00 and arrested me. I only spent one night, but it took me two weeks to find out what the real deal was. Then two weeks later, the police came and siezed my pickup and has begun forfeiture. My pickup has never and as long as I am alive and owner will never hurt a child. I have never been that angry even at people I don't like. I am charged with aggrevated assault with a deadly weapon on the word of a 12 year old known troublemaker.

3 people saw the boy 's finger gesture, and only two witnesses (me and my 12 year old son) saw me yell at the boy from a distance.
