The fact that there are no court orders is your whole problem. You need to change that....and that is why you may need a PI....so that you can find and serve mom.

Sorry but if your check is being garnished and she went thru the county to do that and it is sent to child support enforcement in California then you do have a court order for child support.

You say all of this was done in NC so that is who has jurisdiction in this case and you can start any of your legal actions there as long as you stilll live there.

Now as far as finding her you may have a problem there if she is homeless, however I would try the homeless shelters in the area where she was last known to be. As far as serving her goes you would attempt to send it to her last known address.

Send her a letter to her last known address with "return address requested" on the envelope, if she put in a forwarding address you will get a notice with that new address on it.

So you've known where he was for four of the past five years, yet have done NOTHING about seeing him? :eek:

I am wondering why his sister never informed him that she was in texas for a year and even lived with her for two months.

If this were one of my brothers children and I thought that he was being turned against him I would have called my brother immmediately and informed him about it, not waited for him to call me ands ask about the child.

she didnt go through anyone to get child support. i set it up without prompting from her for ease of operation & to have an official record as to the payments. it wasnt my sister she went to stay with, it was my brothers ex wife & his ex & my ex had been friends from when they both used to live in california yrs ago.

Get an attorney and file for custody and visitaiton, your biggest mistake was not having any other orders, why on Earth did you not want to have any court orders?? THere is more to this story. You at least have the address where she was in TX, start there.
