child molester wants victims counselor records

Hello,
My ex is being investigated for child molestation in Wisconsin. I left him because he was abusive, I had no idea he was doing this other horrible thing. My oldest confided in a counselor what had happened. The court order is that he can't see the kids until this investigation is complete, but he can call them. He tries to manipulate them when he calls. He is now trying to get transcripts from their counselor - the counselor doesn't want to provide them. We feel they need to feel safe in order to recover. Their father had threatened to kill all of us if they ever "told". The law gives him the right to get those transcripts. Is there anything I can do to stop him?

I do have a lawyer, I think he knows my finances are limited. He just said to let the counselor's lawyer handle it. I want to be fully prepared, so I can be sure my kids are safe.

I appreciate any help I can get, to help my children.

He has a right to see any evidence that may be used against him. He can obtain a court order for the counseling records and will be granted it. And most counselors do not have transcripts. Why does yours? Did your child (or you) give permission for your child to be taped?

I've used the wrong word then. He wants their records. I do know the New Hampshire State Supreme Court barred access to records in a similar case, I just don't know the grounds so I can do the same. These kids are terrified, he threatened to kill them if they ever "told". They aren't going to be open with the counselor knowing he'll see every word they say.

Is anything the kids told the counselor going to be used against him in the criminal case? Is the counselor going to testify at the trial?

And have you told the court about the whole "I am going to kill you all if you tell" thing?

That is known as witness intimidation.
