What is the name of your state? Tn/Ky

My husband has noticed here lately when he picks and drops his son off for visits that he is not in no kind of child seat. His son said something to us this weekend about making him sit in a seat he said that his mom does not and that he has not sat in one in a few months. I know here in Tn that it is not okay because his son is 7 and only weighs 45 pounds. Should my husband mention this when it gets closer to court or should he just let this go and if anyone knows the law in Ky I would appreciate it. Thanks!

Yes he is in the seat of the car it's just we thought he had to be in a child seat of some sort being so small. THanks for the link.

'cept she was looking for the law in KY. Which as best as I can find requires child restraint for children under 40 pounds. Which this child is not.

Legal Restraint Requirements for Those Riding in Vehicles in Kentucky
Infants and Children
Kentucky's Child Restraint Law requires that every child less than 40 inches in height be restrained in a federally approved child safety seat.
The following are guidelines for determining the correct safety seat for infants and children: Infants 0-12 months must be restrained in a rear-facing infant seat until at least 20 pounds AND 1 year of age.

Children over 20 pounds and 1 year of age should be in a forward-facing safety seat with a 5-point harness until 40 pounds.

Children over 40 pounds should be restrained in a forward-facing belt-positioning booster seat with lap/shoulder belt until about 80 pounds AND 57 inches in height.
Children over approximately 80 pounds and 57 inches tall can wear adult lap/shoulder belts when the child is tall enough to sit with back and bottom all the way back against the vehicle seat with the shoulder belt across the chest. (Never behind the child.)

this issue is a bit of a per peeve for me....my X tells my daughter i'm a "carseat freak":mad: i think it is CRAZY for there not to be a national standard instead of state by state....here in ca its 6yrs or 60 lbs... i can say without a doubt my 40lb child will still be in her booster seat well past her 6th birthday this week....i just do not get parents who will take any risk with their child's life...i mean really how much commen sence dose it take to see that a car is not made to protect a person that is not average adult size?????(i wish they made booster's for those of us adults who are only 5 foot tall and get chooked by seatbelts)

The word "should"...disturbs me a bit. I am not sure that it means that its required.

Does this "quote" come from the statues or recommendations?

I ask because I have never heard of child restraints up to 80 pounds....there are some adults that barely make 80 pounds.

Our state requires 8 years AND 80 pounds. And I'm sorry, but I'm not going to make my 12yo who is 5' and 74 pounds sit in a car seat. Talk about an instant way to make the child an object of ridicule. And as LDi said - there are adults who would not meet those criteria.

Well it's her time I guess she can do as she wants it will be on her if something happens. It was just confusing the child but he will have to learn that the adults make the rules and that sometimes they do things different. Thanks for your time.
