Question? My wife has joint custody of her 2 boys,ages 13 and 16.The boys live with their father and we get them on wednesdays and every other weekend.The boys have signed affidavits stating they want to live with us instead of their dad.Yesterday my wife asked her ex-husband if she can see the boys for at least 2 hours on thanksgiving day(he gets them today).He said NO,which hurt us and left sadness on the boys' faces.

What can happen to the boys if they decide to visit us on their own and not want to reurn to their father? We are trying to go to court but due to excessive legal expenses,it is taking a long time.The boys father is very mentally abusive and is never there for them,my wife and I buy their school clothes,get them haircuts and give them lunch money,yet their father earns more than my wife and I combined. Can the boys get legally in trouble?

The boys couldnt get into trouble legally but the mother could. For intereference of custody... she is obligated by court order(until it has been changed) to return the children when the court ordered period of visitation is over. Be patient and pursue this through the courts. Do not do anything that would make you lose your visitation rights to the children.

What you need to do is file a motion to amend custody and visitation. This can take a long time. I filed mine in 98 and it not over yet. Make sure you document everything. At their ages I think the court would give consideration to what they want.
