child support again?

My 19 yr. old step child is supposed to receive support until 22 as long as they are a full time student in college. They started two semesters and have dropped out of the first and then went down to only 3 hours the second (during those two sem. we paid support religiously), so we stopped paying child support. Now we have been informed that the child is going back to school. Do we have to start paying child support again? What if we start paying again and the child drops out again? Is there any recourse?

You cannot just stop paying support on your own.

You MUST go back to court and have the child declared emancipated.

If you failed to do that in the past, you are still on the hook for the support during those periods until the child is declared emancipated by the court and the payments are ordered stopped.

Your time to act was when she dropped out of school. That time apparently has passed.

Now that she is planning to go back, you're on the hook for awhile longer.

Next time she drops out, go to court and get her declared emancipated -- or you'll be on the hook for support until you do or she turns 22, whichever comes first.
