I live in Florida, Brevard County.Im recently living apart from my husband. We havent yet filed divorce papers. My ex
receives food stamps and medicare. He claimed the children are with him 51% of the time. We currently share the time with the children 2 weeks per month. Now the state is saying I should be paying child support because he has them more time than I do. This is not true. It is equally shared.
Is there a way for me to fight this. He has filed false information. Im confused and need some helpful advice.

when you do eventually file for divorce Florida has child support guidelines that will calculate for you who pays what. There is nothing stopping you from disputing that he has the children more than you, you can just as easily claim
that you have them 51% of the time. Why has divorce action not been filed yet?

Thanks for the information it was very helpful and a relief to know I can fight against him. I havent filed yet because my ex was hiding the papers for a year and wouldnt give them up as well as financial reasons on my part. Ive learned alot since a years gone by. Things I could have done without him and laws that protect me as well. The situation is far more detailed than this issue with child support. It was an abusive relationship for many years and I never really knew my rights as well as being scared of what I could do without him violently reacting.
