Child support and military in SC

What is the name of your state? South Carolina

I am currently stationed in Texas in the ARMY and am trying to get my divorce from my wife who I have been seperated from for over a year now...the only thing holding it up it childsupport.....we can not agree on what should be used as my income to determine child support...since you get different allowances in the military these thing are so wierd....I am set for an appointment with JAG, but the sooner I can show her proof the better..... we have 2 kids who are my world and fortuantely they understand that daddy has to be gone because of the army...but she doesnt seem to be using the money that she is getting right now to get the things that they needs, and I dont think that she deserves half of my base pay....since i live off base i get roughly 1000 for living expenses on top of my base pay...i have been told that about 200 of this is because of dependants....so I think that she should only be able to use whatever the difference because of dependants is plus my base pay to determine child support. She on the other hand thinks everything I get should count....she wants PROOF WRITTEN ACTUAL PROOF....that she isnt going to get more than I am telling her yet I cant find anywhere that states what SC will count from military pay when it comes to calcualting child support.....ANY HELP MUCH APPRECIATED...AS I AM GOING TO DEPLOY AGAIN FOR MY 4TH TIME...AND DONT WANT ANY STRINGS ATTACHED WITH HER ON THIS DEPLOYMENT....

she is the one who sent me a "dear john" email telling me that she had cheated on me and was leaving me....i have since then...here recently moved on with my life, and want to keep it that way....she is trying to hold things back now but i only think because she wants all the benefits of being an army wife but none of the responsibility.

My gf and I will do whatever for the kids as needed...whether it be send them the things they need, or send my mother the money so that she can get them the things that they need.

Your income that should be used should be what you declared on your taxes. That will simplify things. How much did you declare on your taxes last year? What do your w-2s state?

It is none of your business how she spends the child support she gets. NONE of your business.

South Carolina counts all of your income. So try looking at your W2s. That simplifies things.

Well you will always have strings attached with her so long as you have kids.

So you both have cheated. Not that it matters when it comes to child support or child custody.

You can do that but you will also be paying child support based on your ENTIRE income.
 
I'm not a lawyer, but, I do know a little something about the way military pay and child support works. They will include your housing allowance completely as an income. Say, you get $1000 for housing allowance and your base pay is $3300. That would mean your income that CS uses is $4300. It does not go off of what you file for taxes, as your W-2 won't show your housing allowance. IF you decide to live on base, then it goes off of $3300, as there will be a federal deduction for the housing allowance and they cannot use it. I know this is how it works, as I recently (w/in the past year) went through all this.

Now, if your CS is set up for living off base and you decide to move on base (I did this as my costs of living were higher than what I got after paying the child support on it - I only got $750 for living off base and had to pay $200 in CS, and I couldn't find a house with electric/water/sewer/trash for $550), then you will need to file to modify your child support.

You may also want to find out if you will even get teh dependent pay when you are divorced. I did not recieve the dependent pay after I divorced and my ex received physical custody of my son ... the military did not consider him my dependent for that additional pay as I did not have residential custody.

Just a thought you may want to consider asking someone about.

You may want to check...I live in TX and have found out that even if my ex DOES NOT pay child support I am legally obligated to let him HAVE HIS VISITATION....we women are vidictive....

You know nothing of family law. You cannot dictate how CS is spent.
