What is the name of your state? CA
My husband just found out that a woman he had a brief affair with 18 years ago is now saying that he is the father of her daughter. She was married to someone else at the time. Is my husband responsible for any back child support if this is true? As you can tell, the daughter is now over 18.

If no support has been ordered, then he is not liable for any support.

I have done some checking and California is a tough state. There is no statute of limitations on the age of the child when support can be sought or how far back they can go to collect. In theory, the custodial parent could seek back support for the full 18 years that it was not paid. Ouch.....

I agree with ndecker & zigner that he MAY not be responsible for any back child support payments. However, he needs to contact a lawyer that is in family practice to verify the law in Ca. It is possible since there is no current proof by affidavit or custody/support order in effect that child support is owed, he may not have to pay back payments. They may "vote" in husband's favor because nothing before now was requested by daughter's mom.
Is he positive the "daughter" is his?

I find myself wondering if the "father" has a case against the mother for her failure to provide him an opportunity to participate in parenting without due process.

This post is 24 days old. WHY are you responding. I'm guessing that your SHORT time here is limited. Mary.....
