we live in alabama. my husband pays child support for 9 1/2 months a year, starting august 1st and ending may 15. for 2 1/2 months his ex-wife is required by a court order to pay child support to my husband because the children are in his care while school is out. the kids are older now and do not follow the visitation guidelines stated in the decree. they only come when then want to. my question is, does his ex wife still have to pay child support to him if the children do not stay the entire summer with him?

she is required to pay the support until it is modified.

there is the possibility that she could request the modification and have it changed since the kids are with her more during the summer now.

We were in court only a couple of months ago. She agreed to the situation then and she knew there was a possibility that the kids wouldn't stay with us throughout the summer. She made no attempt then to eliminate our summer visitation and obtain child support during that time. How soon before she can go back to court to have this modified? Also, since she's made no attempt to pay her child support, what are our rights and how do we enforce payment? How late does she have to be before we can do something about it? She was supposed to pay for 1/2 a month in May which was due the 15th of that month. The payment for June was due on the 1st of this month. She has so far paid nothing.
