My child support arrears are way outrageous, and my income from prior years was no more than $10,000.00 to $15,000.00 per year and I was not even able to support myself on that amount. I lived paycheck to paycheck. I never knew I had to change my child support amount myself. I thought that Child Support was modified automatically by my yearly income. What are the procedures for modifying my child support arrears? I also need to know how to figure the new back child support amount. What if my ex-wife, the obligee, does not provide all her income information or the child expenses? Can I go to the Child Support Enforcement Agency in New Mexico for help on this concern?

You will only be able to lower the payments from the date of filing through the future.. IF the CSEA will even lower them then.

Most times they will say that you are capable of making XX amount of $$... The figure based on what your income was when the CS was first established.

The arrears will be there, but they may allow you to make payments over the amount of your regular CS payment to try to offset that amount.
