Child Support Case in NC

Hi, I was hoping I could get some advice for one of my young soldiers. Here is his question.

He has a daughter and is paying child support through the state of North Carolina. Both, him and the mother who is also a soldier were based in North Carolina when she filed for child support. He is trying to get his case modified. He has since had two other children and his income has changed. He receives lower Basic Allowance for Housing BAH and no longer receives his jump or other specialty pay. His is currently paying $650 dollars a month. He is an E-4 not really a high paying rank in the Army. He has been in Texas since last March. The mother was stationed in Fort Sam Houston,Texas until last week and has now moved to Fairfax, Virginia. He called North Carolina to see if he could have it modified since the order was in NC. He was told he could not since both parents were no longer in NC and he could register the order with Texas. He spoke to an agent in Texas who asked him to fill out the application provide the order from NC and told him they would take the case since both parents were no longer in NC the state of Texas could take jurisdiction. Today, he found out she has been stationed in Fairfax, Virginia. Now he wonders can Texas still take jurisdiction of the case. She just arrived in Virginia last Friday 05/04. With that being the case could he still register the child support order in Texas? Does Virginia now take jurisdiction since the custodial parent is now in Virginia?

Someone else will have to help you with the jurisdiction issue...

How much has his pay decreased since the order was put in place?

Has mom's pay increased/decreased?

Here's a link (you'll have to copy and paste the info) to a worksheet that the state of NC uses to figure out CS amounts. NC's guidelines will be used no matter where jurisdiction ends up.

It's possible that unless Dad's income has decreased quite dramatically (and by that I mean by 50% or so) AND the CS amount would change by 15-20%, then the order would not be changed.

Dad's new children are unlikely to be a factor.

I am trying to get similar help for my bf in SC....can you tell me what they go off of to determine child support...from the soldiers pov....since there are so many different pays....and you only get so much bah to live off of...and just because you have dependants you only get so much more....any info would help.....


but a little help for you is that yes.....in order to get corrections, since HE lives in TX...AS WE DO!....go through the Attorney General and they should be of great help to you...and they will go off of current pay....though as I said Im not sure what is considered when it comes to military pay...but it will be 20% for 1 25% for 2 kids...maybe with a little consideration for the fact that there are more children being supported...it may be reduced...but the AG in Texas is a great help!
