What is the name of your state (only U.S. law)? California
Hi, I'm planning on asking for a modification of child support base amount and add-ons (based on change in incomes). I've consulted with a couple of attorneys by phone and one said something I never heard before - that base child support is generally *lowered* as children get older. I've looked online and can't find any support for that statement. In fact what I've seen is that children cost more as they get older(e.g. http://www.kinseylaw.com/clientserv2/famlawservices/modifyorders/modifychildsupport/modifychilssupport.html). Does anyone know if this atty is correct? I'm trying to choose between 2 attys to hire and I want one who knows what he/she is talking about. Thanks.

California uses a shared income forumla. The court will enter the data in a program that will put out the results. The numbers generally are incomes of the parents, time with each parent, any hardships allowed, insurance payments, etc. Age of the child is a factor where daycare and afterschool care is concerned. When you consider the cost of daycare and afterschool care, yes the amount decreases as the children age as the cost of care decreases.

the only thing that i can think of beyond what was previously mentioned was if this was a multiple children situation.

just for kicks....

4 kids...5, 7, 15 and 17 years of age. when the 17 year olds turns 18, the child support is lowered. when the 15 year old turns 18, child support again lowered.

only because a child is aging out as the years go on.

but generally speaking...barring any issues...child support does not decrease with age. there are more situations where it increases.
